I've moved away a bit from using smudge since i made that tutorial. I dont feel the need for making skin all smooth all the time.

Because legally it is?? Fanart is called a "Derivative Work". In the U.S. derivative works are illegal if you sell them. If you do not own copyright/trademark of a character, legally you should not sell them for profit.

There is a gray area that many artists respect and tread carefully- such as fan art pieces at anime/comic cons. Many agree that is okay to sell one time commissions of a single composition of art. For Ex. a girl might commission Merida from Brave. You can create the image and sell it. If another person asks for Merida, you should create a whole NEW piece of fanart rather than copying/selling the first Merida picture.

Copyright LITERALLY means to protect the rights to COPY. If you're making more than ONE copy of a piece of work then you are mass-producing something and selling it for profit. You can't legally do that with characters you don't own.

Many amateurs do it and quite a few pros do. The pros i've seen do it have usually worked in the business or for the company they are creating fanart, but essentially it's still illegal.

I avoid all legal ramifications by not selling fanart. I should have no OTHER reasons justifying it when the laws are in place. Are they fair? Over all, NO, but are they consequences to me? YES.

Unfortunately, there are many other factors that only further limit a person's ability to sell fanart such as Trademark. A whole other set of laws. I wouldn't worry about it though. As long as you're not being loud about it or trying to produce fanart in a way that someone might think YOU are the original creator then it doesn't pose a problem for most companies. Big names really don't lose profit from things like that....

but that's my point. As a freelance artist and as my own company, I WOULD LOSE BUSINESS if some jerk started selling 'fanart' of character of mine if it barely made a name for itself. Maybe my character is popular, but i would not have the money to hire lawyers to protect my rights like a company would. I just don't think laws should be double-sided. Even if big companies won't lose money, i won't do something to them i wouldn't want others to do to me.

However, I was wondering if I drew a character from a certain comic book in my own style, changing alot of the design, Or if I took an anime character and drew it in a photorealistic style and then sold it, even if I gave credit to the company (which was a very big one, hardly likely to care about a few dollars) would it still be wrong?

Since I would be crediting, while making alot of it in my own style. And the company had millions of dollars already, 20 bucks wouldn't make much difference.

ultimately, it's still your decision. ultimately, it is still illegal. Ultimately, if you don't mind someone doing that to your character (making the changes you suggested), then do it.

Again, it's just out of respect that i don't do that to other peoples hard worked characters. If you're doing it for family or close friends, perhaps it won't matter, but don't let it start to be come a real "side" income. It needs to be YOUR work completely. What happens when the only thing you have to put in your portfolio for proof of experience is a bunch of stylized fanarts sold as commissions??

I hope this helps. Those are just my points/arguments. People do it everyday like rolling stops at stop signs and not turning in certain profit for taxes, but there is always a chance of getting caught, and if you do, you've no legal way to justify your doing so.

I've only ever had one male cat. He was my baby boy. I was with him 7 hours the night he was dying of old age. It was the saddest experience I have had, but he lived a good 14 years as an orange tom cat with chipped ears, a kinked tail, and the biggest jowls I've ever seen on a cat! (you could cup them in your hands lol )
