Nintendo Letter reads in part: "Although we are unable to grant permission, use of Nintendo properties without our formal permission may still be allowed depending on the circumstances."
However, as I said before, even though I do not think there is a specific Copyright Law about computer wallpapers, I will remove such wallpaper to be in good terms with the company.
I hope we are learning how to communicate with others before empty accusations are made.
