Description If you google for "dove" you will find some photographs with exactly same pose of those two doves in this pic, yes, that will be my references of this pic, and I always use references to help me to proceed commissions, it seems complete normal and reasonable to me, until I saw something last year: someone took my old prctice painting as a "reference" and refine it to make it a book cover without notice.

They admited they did took my painting "as a reference", and there is nothing wrong to do that.
At first, I feel insulted and confuse, a little bit angry, then I start to afraid, I'm not really care what they do or what they want to be, but is there anything different between me and them?
am I also a thief of other one's idea and creaction? and a thief who doesn't think himself is a thief? my friends, please stop me if I become one of them.

as someone who gets reference from other artists, i do tend to feel like a thief but i also have accepted the fact my knowledge on the human anatomy and posing is minimal as I have no previous training. Referencing is crucial to a healthy ever growing artistic field as long as you don't copy the other artist's work to a tee and call it yours. After all, look at all the people who draw their own versions of Disney characters! Nobody calls them thieves! As one who once had an original character stolen by someone I can understand being worried or angry about seeing your artwork stolen. Yet you should also feel pride in the fact your art work is so inspiring to others! It was certainly inspiring to me though I would let you know first if I was going to use any of your artwork >.<

And on the subject of stealing, no, I don't think that's what you are doing. I haven't looked at any of your other works, but judging from this one, you use another picture for a small fraction of your work. It's still your own skills and originality. I clicked the link, and the resemblance is uncanny. They use the same pose, same body shape, hair flowy thing, cape, etc. All they did was change colors and such. THAT is what I'd call stealing. That is NOT using as references. It's like tracing and saying "Look how good I draw!" And tracing is one thing if it's for private use to get an idea how to draw something. To publish that on a book is a TOTALLY different thing. So in conclusion: They stole, you don't That's just my opinion, but I don't think you should get too worried about this, because you truly have skills, and you aren't a thief or anything like that

You feel angry because you know your work has been exploited and your copyright infringed. 'Reference' doesn't mean copying an existing image and tweaking a few things to make your picture slightly different to the source image. Any time an artist's work is a clear and obvious derivative of an existing picture, that artist should be getting permission and giving credit. Easiest way is to avoid these implications is to use free-use stock or to take your own photographs, but heavily referencing or copying a single or complete image still means you're using that image as a crutch rather than studying it to fill in a gap in your own understanding, and transferring that new understanding to your work.

I love the above pic. nice action and wonderful doves....having said that. I would sue them over the use of the claymore cover...they didn't even modify the flow of the cape....sigh. Some people have no respect. Love the above pic, though.

They clearly stole your work giving that picture. Like you said, you had no notice of it, they just took it, ran with it and now it's on a book cover. Personally, I'd be so pissed and sue them because they didn't get your permission in the first place. The artwork is way too damn similar and I'm sure they know it. I bet they are only claiming they used it as a "reference" so they don't get in trouble with you personally. But just the fact you had to find out because it wasn't brought to your attention in the first place, I wouldn't let them get away with it.

I don't think you stole anything. The dove you're talking about were really just references as you said IMO. Mostly for their pose and for what such a bird looks like... The guy who you're talking about, though, uses your pic as more than a reference... your two pics are too similar indeed... Once again, that's just my opinion. They did the same outfit, the same folds in the cloak, the same hair... They at least should've credited you.

Oh and great piece, I love the colors and the general feeling that the (beautiful!!!) young woman is really running...

Art and theft is a touchy thing. We all get ideas from somewhere, and in the end our work may reflect our inspirations. The trick is to make our style our own. As to those two pictures, it looks like a little more than reference. It looks like even the style is the same. If they did paint it all themselves and just managed to capture the pose and style exactly, there's unfortunately nothing illegal i don't think. But as an artist, I would have at least tried to change something so that it's not a near exact copy. That just seems lazy and disrespectful, despite the obvious skill that went into it.
