He wont. Ether contacted him directly and he just ignores it. DeviantArt won't even enforce their infringement policy, claiming this image is too vague to be considered infringement. DA is slacking and I find it quite disappointing.
Not only does he not credit Ether (the original author), but Ether hasΒ Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 License Β which implies no remix, transformation or modification of the piece is to be published.
Download Ether's original "Sleepless" photo and slap a Gaussian blur on it, you will have this result, nearly to the pixel.
