while the term "Mutant" and anything relating to them is under the copyright of Fox studios, quicksilver and scarlet witch are considered more avengers characters in the comics, so Disney can put them in the movie, but they cant call them mutants or mention that magneto is their dad. so they'll be given new back stories in avengers 2. god, i hope my explanation of complicated copy right law wasn't too boring.
