I just wanted to say thank you for helping to spread this information. I wish it was common sense, and I hate that those who care about this issue receive so much backlash from the "con-artists" out there trying to make a quick buck. I wanted to make sure you know other artists appreciate the effort!

Thank you so much! I received a ton of horrible comments on that video, to the point that I had to disable comments for my own mental well-being. Things like people verbally attacking me, telling me to "suck it up" and "deal with it" because "people are going to do it no matter what". I only made the video for educational purposes for the huge amount of artists and others who don't know it's illegal, to protect them from getting in trouble and to keep artists and their work safe. Making that video made me realize just how bad the situation has gotten, where people were telling me to "shut up" and calling me a "bitch" for explaining an often misunderstood or unheard of law. I can't believe so many people still think it's okay to make a profit from someone else's content.

The most angry and aggressive people are almost always people guilty of trying to sell fan art. It's not easy dealing with that kind of abuse, though, especially when you're just trying to be helpful. It also irks me pretty deeply when I discover artists I like, or follow, peddling the nonsense that fan art is should be in any way encouraged. I'm sure some people genuinely don't know selling fan art is wrong, but I think most people just don't understand how to turn their creativity into a successful business. I mean, I have such a hard time believing that anyone could really think it's okay, that I literally assume they're lying because they don't want to put in the work. I've seen some artists (who I choose not to follow) blatantly admit that they know it's illegal, but do it anyway. They want to make a quick buck, and they don't think they'll get into trouble.
Things wouldn't be so awful if there was any sort of accountability. Convention organizers shift the responsibility to the exhibitors in their agreements, saying it's not the con's fault if copyright infringement happens. As if the IP holders can afford to post representatives at every convention in the US each year with cease-and-desist orders. Not that many would, because they're afraid they'll alienate the small percentage of their fans who might be offended by not being allowed to exploit their property. Not unfair since those small number of people will make protecting your IP look like a bad thing somehow. "I'm just a little guy, and they're a big greedy corporation!" The saddest part being that the average middle to low class person will eat it up!
It really is out of control, and I think convention organizers are in the best place to inform and enforce. Especially a big one like Comic-Con, with a cool $20 million in the bank. It wouldn't take that long or be that difficult. You see familiar characters for sale and you ask for a license. If they don't have it, you ask them to pack up. I don't think it's unfair, it wouldn't be that expensive, you'd bypass all the legal hassle because the organizers have the full legal power to decide who can exhibit at their event, and you set a good example.
Anyway, I'm sorry you received so much criticism on your video, and I'm glad it's still up. The more artists who share about this stuff, the better!

Comic-Con actually did a panel on copyright law a few years ago or something, which I watched on Youtube sometime after I posted my video, so they have actually talked about it at the convention and explained what is okay and what is illegal. My biggest issue with it all is that when someone posts a lot of fanart, especially when they do commissions or sell merch or prints of copyrighted characters, they develop a huge fan base of all the people who are fans of that game/show/series/comic/whatever it may be. So then, all these artists that are earning a profit from fanart also have huge fan bases that will defend the artist aggressively, so the artist is convincing all their fans that it's okay to earn money from someone else's work, and anyone who bothers to argue gets attacked by the fans.

I think I saw the video you're talking about, with the guy from deviantART? I appreciate that there were some straight up answers in there. I don't necessarily appreciate the implication about getting away with certain things because of a culture of acceptance or inaction, though. It's crazy to watch that video and see the comments, because even with the lawyer standing there telling you it's illegal, unequivocally, some people are only hearing the part about how unlikely it is that you'll get in trouble. If it's unlikely you'll get into trouble, unless you make a lot of money, where you'll almost definitely get into trouble, what's the freaking point?!
And Yeah! It's super frustrating when it's the fan base on the attack, supporting the infringing artist blindly. I've seen so many vicious, empty-headed comments from fans. Seriously, visit a single reputable site and form your own opinion, cause this artist is leading you way off track! And it makes it obvious how important it is for prominent artists to stand on the right side of the line. The artist almost definitely knows better, but either way, you're giving people the impression that there's nothing wrong with this shady behavior. It's called artist integrity people, you have a responsibility to set an example when people are looking up to you. You can tell guys like Will Terry have none, when they're actively trying to convince people to support and encourage the sale of copyright infringing fan art. Artists like that do a lot of damage when they get an audience that doesn't know any better.

He might have been from DeviantART, but I don't remember for sure. And oh wow, people actually said that in the comments? I don't know whether I bothered to read them or not because the video was so serious and clear that I thought there'd be no way anyone would be arguing about it when the speaker is an actual lawyer. Just because there's a good chance you'll get away with it doesn't mean you will, and it doesn't mean it's okay or right.
Yeah, some fans are so loyal that they ignore all common sense and morals to defend their idols no matter what, even when a quick Google search clearly states they're wrong. Artists need to set a good example because their fans look up to them for guidance and inspiration.
