Still workin' on 3D models for some other types of food, so most likely when I get back into this "phase" I'll have some more variety too.

No, "phase" is about right; it's not like it's something I'll move on from later, but I do tend to shift moods every so often, and work on different subjects at different times. It's a phase I'll get out of, and then back into again. (and so on and so forth.)

Yes, most (though not all) of the 3D work you see out there is done using Poser or DAZ Studio, which is essentially a 3D posing program (thus Poser's name). They come with pre-made figures, and you can add on lots of extra shapes, styles, clothing, hair, props, scenery... or if you're a bit more technical, you can create your own content as well.
DAZ is probably the best example; they make the current most popular figures, and you can see just how big of a selection of add-ons there are in their shop.

3DS Max is a full 3D modelling program, so you'll be creating your own models from scratch. Of course, you can always find models other people have released online that may be of use to you (it's not too hard to find animation-ready figures online), but otherwise, it's intended for creating your own stuff.
It's one of the more popular software choices, so there's a good amount of content out there! But nothing quite as easy to use if you're looking to get right into creating scenes. (you'll do best there either using one of the posing programs - which might require a fair bit of additional content - or just making your own figures and stuff, since anything people release for free is usually going to be pretty basic.)

Plenty of tutorials out there, so it shouldn't be terribly hard to create your own stuff. Just very time-consuming!
Downloading other artist's models and studying them can be a huge help in the learning process, as well. (lots of folks will release models for public use.) Just make sure not to take any pieces of their models, of course.
